Acquire Weekly is operated by Reach Digital and provides a weekly newsletter featuring hand-selected off-market business acquisition opportunities, along with premium advisory services for business acquisitions.

Our SMS program complies with the CTIA Short Code Monitoring Handbook, TCPA (Telephone Consumer Protection Act), and all applicable telecommunications regulations. By participating in our SMS program, you agree to receive text messages from Acquire Weekly at the phone number you provide.

2. Description of Services

2.1 Newsletter Services

  • Access to archived deal listings and content

2.2 Premium Services

Our Continental offering includes:

  • Personalized deal sourcing from our proprietary deal flow

  • Dedicated team support for acquisition process

  • Exclusive Slack community access

  • Access to 1000+ off-market deals

  • Custom deal sourcing via direct outreach

  • Priority access to deal flow opportunities

  • Ongoing 1:1 support until successful acquisition

2.3 SMS/Text Messaging Services

  • Business opportunity alerts and deal notifications

  • Weekly newsletter reminders

  • Service updates and announcements

  • Important account information

  • Time-sensitive deal opportunities

3. User Accounts

3.1 Account Creation

You may need to create an account to access certain features. You agree to:

  • Provide accurate, current, and complete information

  • Maintain the security of your password

  • Be at least 18 years of age

  • Notify us immediately of any unauthorized access

  • Be responsible for all activities under your account

3.2 Account Termination

We reserve the right to terminate or suspend accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Subscription and Payment Terms

4.1 Subscription Plans

  • Premium paid services (including Continental offering) available at published rates

4.2 Payment

  • Payment required upfront for premium services

  • All fees are non-refundable unless otherwise stated

  • You authorize us to charge your payment method for all fees incurred

  • Premium services: Cancellation terms specified in individual service agreements

Note: Opting out of SMS does not automatically unsubscribe you from email, and vice versa. Each communication channel has separate opt-out mechanisms. You may opt out of one while remaining subscribed to others.

5. Intellectual Property Rights

5.1 Our Content

All content, including but not limited to text, graphics, logos, business listings, analysis, and software, is owned by Acquire Weekly or licensed to us and protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not:

  • Reproduce, distribute, or create derivative works

  • Reverse engineer or attempt to extract source code

  • Use automated systems to scrape or download content

  • Resell, sublicense, or transfer access to others

6. User Conduct

You agree not to:

  • Violate any applicable laws or regulations

  • Infringe upon intellectual property rights

  • Transmit malicious code or engage in hacking

  • Impersonate others or misrepresent affiliations

  • Harass, abuse, or harm other users

  • Use the Service for unauthorized commercial purposes

  • Share or distribute business listings without authorization

  • Use SMS services for spam or unsolicited messages

  • Share or transfer your SMS opt-in with others

  • Use automated systems to interact with SMS services

  • Abuse the HELP or STOP keywords in our SMS program

7. Business Listings and Opportunities

7.1 No Guarantee

  • Business listings are provided for informational purposes only

  • We do not guarantee accuracy, completeness, or current availability

  • Listing inclusion does not constitute endorsement or recommendation

  • You are responsible for conducting your own due diligence

7.2 Third-Party Transactions

  • Transactions occur directly between buyers and sellers

  • We are not a party to any transaction

  • We are not responsible for disputes, losses, or damages arising from transactions

  • Professional advice (legal, financial, accounting) should be obtained independently

WE DO NOT GUARANTEE MESSAGE DELIVERY, TIMELINESS, OR ACCURACY FOR EMAIL OR SMS COMMUNICATIONS. CARRIERS ARE NOT LIABLE FOR DELAYED OR UNDELIVERED MESSAGES. WIRELESS CARRIERS AND THEIR AGENTS ARE NOT LIABLE FOR ANY ISSUES RELATED TO OUR SMS PROGRAM.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACQUIRE WEEKLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM:

  • Use or inability to use the Service

  • Business acquisitions or investments

  • Errors, inaccuracies, or omissions in content

  • Unauthorized access to your account

  • Third-party conduct or content

  • Delayed, failed, or undelivered email or SMS messages

  • Issues with wireless carriers or telecommunications services

  • SMS message and data charges from your carrier

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Acquire Weekly, its officers, directors, employees, agents, and service providers (including telecommunications providers) from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service

  • Violation of these Terms

  • Violation of any rights of another party

  • Your business acquisition activities

  • Your use of SMS services or provision of an incorrect phone number

  • Any disputes with your wireless carrier

The Service may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third parties. Access is at your own risk.

Our SMS program is operated through third-party telecommunications service providers. While we use reputable providers, we cannot guarantee uninterrupted service or delivery of all messages.

12. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection, use, and disclosure of your information as described in the Privacy Policy.

13. SMS/Text Messaging Program Terms

13.1 Program Description

Acquire Weekly SMS Notifications - By opting into our SMS program, you will receive business opportunity alerts, deal notifications, weekly newsletter reminders, service updates, and important account information related to Acquire Weekly's business acquisition platform. This service enhances your ability to stay informed about time-sensitive opportunities.

13.2 How to Opt-In

You can opt in to receive SMS messages by:

  • Providing your phone number and checking the SMS opt-in box on our website

  • Texting START or JOIN to +1 985-322-6346

  • Providing your number during account registration and consenting to SMS communications

  • Opting in through your account settings

By opting in, you expressly consent to receive automated marketing and informational text messages from Acquire Weekly at the mobile number provided.

13.3 Opt-Out Instructions

You can cancel the SMS service at any time. Just text "STOP" to [YOUR SHORT CODE/PHONE NUMBER]. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

13.5 Message Frequency and Charges

  • Message Frequency: You will receive approximately 2-5 messages per week. Message frequency may vary based on your preferences, account activity, and availability of time-sensitive opportunities. During peak periods, you may receive additional messages.

  • Charges: Message and data rates may apply for any messages sent to you from us and to us from you. Standard message and data rates from your wireless carrier will apply. If you have any questions about your text plan or data plan, please contact your wireless provider.

  • No Additional Fees: Acquire Weekly does not charge additional fees for SMS messages beyond standard wireless carrier rates.

13.6 Carrier Liability

Carriers are not liable for delayed or undelivered messages. Wireless carriers and their agents are released from all liability for any issues related to the SMS program, including but not limited to delivery failures, message delays, or service interruptions.

  • Your phone number and SMS consent information are governed by our Privacy Policy

  • We do not sell, share, or transfer your phone number or SMS consent to third parties, including affiliates

  • Your consent to receive SMS messages from Acquire Weekly cannot be transferred or shared with any other entity

  • Our telecommunications service provider is contractually prohibited from using your consent for their own purposes

13.9 Age Requirement

You must be 18 years or older to participate in our SMS program. By opting in, you confirm that you are at least 18 years of age.

13.10 Device and Connection Requirements

  • You must have a text-messaging-capable wireless device

  • You are responsible for maintaining an active mobile phone service with a participating carrier

  • Standard data and message rates from your carrier apply

13.11 Program Changes

We reserve the right to modify or discontinue the SMS program at any time with notice. Material changes to message frequency, content, or terms will be communicated via SMS or email.

13.12 TCPA Compliance

This SMS program complies with the Telephone Consumer Protection Act (TCPA) and requires your express written consent before sending marketing text messages. By opting in, you provide such consent.

14. Modifications to Service and Terms

14.1 Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of the Service, including the SMS program, at any time with or without notice.

14.2 Terms Changes

We may update these Terms from time to time. Continued use after changes constitutes acceptance. Material changes will be communicated via email, SMS (if you're enrolled), or Service notification.

15. Termination

15.1 By You

You may terminate your account at any time by:

  • Clicking unsubscribe in any email (this terminates email only)

15.2 By Us

We may terminate or suspend access immediately, without notice, for:

  • Abuse of SMS services or spam behavior

  • Extended inactivity

  • At our sole discretion

15.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately

  • We may delete your account and data

  • You will no longer receive emails or SMS messages

  • Access to premium services ends

  • Provisions that should survive (disclaimers, limitations, indemnification) remain in effect

  • No refunds will be provided for unused premium services

16. Dispute Resolution

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law provisions.

16.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions, class arbitrations, or representative actions.

16.4 Exceptions

The arbitration agreement does not apply to:

  • Injunctive or equitable relief for intellectual property infringement

  • Disputes that cannot be arbitrated under applicable law

17. General Provisions

17.1 Entire Agreement

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

17.3 Waiver

Failure to enforce any provision does not waive our right to enforce it later.

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including telecommunications failures, carrier outages, internet service provider issues, or acts of God.
